PROGRAM APPLICATION AGREEMENT

The following describes the terms and conditions of the U.S. Event Guide Agreement (“Terms and Conditions” or “Agreement”) entered into by you, the party identified on the signature line below (“Student”), and U.S. Event Guide ("Company") regarding the U.S. Event Guide Combined (Event & Wedding) Certification: E-Study (“Program”). Student and Company hereby agree and acknowledge as follows:

PAYMENT

Terms and Conditions of payment are as follows:

1. Student shall be responsible for all charges in U.S. currency.
2. Charges are exclusive of taxes. Student is responsible for paying all taxes, government costs, collection agency charges, reasonable expenses, and attorneys’ fees Company incurs in collecting delinquent payments.
3. On each returned check, Student’s account will be assessed a fee of $35.00 in addition to a late payment penalty of $50.00.
4. Late payment fee of $50.00 will be assessed if payment is not received on the due date.
5. An application fee of $295.00 is included in the Program cost. This fee is nonrefundable.
6. It is Student’s responsibility to inform Student Accounts at certification@useventguide.com of any changes to [his or her] registration information.
7. All check or money order payments must be mailed to 13027 Clarksburg Square Road, Clarksburg, MD 20871.
8. With the completion of the Program Application Agreement, Company will email Student the Enrollment Agreement. Enrollment Agreement must be submitted to Company’s main office within 30 days of submitting payment or Student's account will be assessed a service fee of $150.00. Upon 24-72 hours of receipt of the Enrollment Agreement, Student will receive via e-mail a link with [his or her] username and password with which to access the online training site.
9. Certification will not be furnished until Student’s account is paid in full.

 

REFUND AND CANCELLATION POLICY

Within 30 days of payment, Student is entitled to a full refund less the $295.00 processing fee by notifying Company of cancellation prior to accessing the Program. No refund will be issued after 30 days of payment. The steps below specify how to cancel Program:

Step 1: Submit the Enrollment Cancellation Form at http://www.useventguide.com/form/enrollment_cancellation.htm.
Step 2: A written cancellation notice must be mail to Company at 13027 Clarksburg Square Road, Clarksburg, MD 20871. Written notices of cancellation are effective from their postmarked date. It is Student's responsibility to email certification@useventguide.com to ensure that both the online cancellation and the written cancellation notice have been received by Company in order to start the cancellation process. The cancellation date is only effective on the day Student mail out the written cancellation notice.

If Student is not eligible for a refund but proceed with a chargeback through [his or her] credit card company, Student will be subject to a $395.00 administrative fee.

Delinquent payments will be handed over to a collection agency and the indebtedness reported to a credit bureau. All collection costs will be added to Student’s Program fee. By signing this contract, Student agrees that the Program must be paid in full, regardless of course completion. Nonrefundable fees are nonrefundable without exceptions.

 

CAREER OPPORTUNITY

Upon completion of Certification Program, Company provides no guarantee as to Student’s income or employment.

 

GOVERNING LAW, DISPUTES, & FEES

This Agreement as well as the legal relations between the parties involved will be governed in all respects, including validity, interpretation, performance, and effect by the laws of the District of Columbia. Each party, to the fullest extent permitted by applicable law, hereby irrevocably waives all right to trial by jury as to any issue relating hereto in any action, proceeding, or counterclaim arising out of or relating to this Agreement or any other matter involving the parties hereto. The parties expressly and irrevocably consent and submit to personal jurisdiction and venue in the District of Columbia. Student agrees that any legal action or proceeding between him or herself and U.S. Event Guide for any purpose concerning this Agreement or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in the United States District Court located in the District of Columbia, United States of America. The prevailing party in any dispute will be entitled to all costs incurred, including, without limitation, reasonable attorneys' fees and court costs.

 

SEVERABILITY

If any term of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then this Agreement, including all of the remaining terms, will remain in full force and effect as if such invalid or unenforceable term had never been included.

 

ADVICE OF COUNSEL

Student acknowledges that, prior to executing this agreement, Student was offered the opportunity to have this Agreement reviewed by counsel of Student's choice and that Student either has, in fact, obtained advice of counsel or has expressly and knowingly waived Student's right to do so.

 

MISCELLANEOUS

No amendment or modification of this Agreement shall be valid or binding upon the parties hereto unless made in writing and signed by each of the parties hereto. Any cause of action or claim Student may have with respect to the Program must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. U.S. Event Guide's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. Student may not assign [his or her] rights and duties under this Agreement to any party at any time. This is the entire Agreement between the parties relating to the subject matter herein. If any provision of this Agreement is found by a court of competent jurisdiction to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of this Agreement or the remaining provisions hereof.
